The New Orleans Medical Malpractice Attorney and the Medical Malpractice Claim in Louisiana

In Louisiana, a patient is not allowed to institute a claim for medical malpractice unless he first submits his claim to a medical review panel. A request for a medical review panel must be filed by your New Orleans Medical Malpractice Attorney within one year of the date the patient either knew or should have known of the medical malpractice. In no event may your New Orleans Medical Malpractice Attorney ever file a request for a review panel more than three years after the date of the malpractice.

A medical review panel is made up of an attorney chairman who oversees the process and three physicians in the same medical specialty as the defendant doctor. Your New Orleans Medical Malpractice Attorney and the defense submit evidence to the medical review panel in the form of depositions and medical records. The medical review panel then decides whether the health care provider breached the standard of care and if so, whether that breach resulted in damages to the patient. Approximately ninety-seven percent (97%) of cases submitted to medical review panels in Louisiana are lost by the patient.

Once the medical review panel renders its decision, your New Orleans Medical Malpractice Attorney has ninety days (90) to file suit in a state district court. However, the decision of the medical review panel and the testimony of the physician panelists are admissible at any trial of the matter.

Louisiana law also requires that claims for medical malpractice must be proven by expert medical testimony. Thus, these cases frequently become a battle of medical experts between the defense lawyer and your New Orleans Medical Malpractice Attorney. Expert witnesses are very expensive to hire. The experienced New Orleans Medical Malpractice Attorney will only select the top experts in their field of specialty. Since most local physicians are reluctant to testify against other local physicians, it is often necessary to hire an expert from out of state.

Given the tremendous expense involved in handling medical malpractice cases, the patient’s injuries and damages must be severe and permanent to justify proceeding forward with one of these cases.

New Orleans Medical Malpractice Attorney Can Also Assist with Your Personal Injury Claim

If you have been injured in an accident due to the fault of another, the New Orleans Medical Malpractice Attorney may also be able to assist you with your personal injury claim. Whether it is an automobile accident, a maritime injury, an injury from a defective product or defective drug, the New Orleans Medical Malpractice Attorney also has experience with these matters.

Personal injury attorneys represent victims who have been injured due to the negligence of another. However, many personal injury attorneys do not have the extensive medical background that will give them an advantage to handling the case. The New Orleans Medical Malpractice Attorney has extensive experience in proving all types of medical injuries. His unique background gives him an advantage over personal injury attorneys who do not understand the medicine of the case.

Mr. Mitchell (Jeffrey) is still representing me in this case. It has been ongoing for almost seven years. Jeffrey began my representation in 2003. For various reasons, other attorneys within his firm represented me. About a year ago, the attorney assigned to me had to resign. I was quite upset, but Jeffrey was kind enough to take my case, and to reassure me. Putting my fears to rest, he has proceeded with gusto to get the case settled. He has always kept me informed. He has shown tremendous knowledge of the law, as well as the medical aspects of the suit. When I had to give my deposition in front of three attorneys, representing three different doctors, he educated me thoroughly, allowing me to relax and show my belief in myself and my suit. Beyond any doubt, it was because of Jeffrey that I was able to answer questions confidently, while revealing my integrity to those other lawyers. He has supported me in every possible manner. I feel my suit will finally be settled this year because Mr. Mitchell is going to do what needs to be done to get it settled without further delays. The qualities I most admire in Mr. Mitchell is his body of knowledge and his professionalism. His depositions are truly works of art. He is always sure I understand what is happening and what needs to be done next. He makes time for me when I have a question, or when I need clarification on anything. He never puts me off; he demonstrates that not only is my case important to him, but that I definitely matter to him. There is no higher compliment I could give him than this: Jeffrey Mitchell gives lawyers a good name. He is an intelligent man, a "legal artist" with an amazing ability, and he presents these qualities to his clients, while showing a kindness that touches one's heart.
